Warning to our customers !!! Infringement of C3 Systems, SL intellectual property and industrial rights
C3 SYSTEMS, S.L. has noticed that some competing companies are exploiting commercially systems and enclosures in Spain infringing our rights of intellectual property and then acting unfairly. This behaviour is unacceptable and incorrect or even irregular from the point of view of good faith in the objective sense.
Through this, we inform our customers that, for some time, several companies are trying to sell their enclosures, much lower quality, like a closing "seeglass". This illegal use of the mark is being made through Internet campaigns, publications, catalogs and brochures, billboards, sales tours, etc. All this is causing great harm to C3 SYSTEMS, SL, not only from the economic point of view but also from the point of view of our reputation and prestige of the brand "seeglass" which meets the highest standards of quality, with a great team, which strives every day to go further improving the final product.
No doubt, these imitations are of poor quality in all components, including lacquered profiles, as do not provide the necessary quality certificates. In most cases, the product is not Spanish or European; among the prices quoted they are not including certain necessary components for installation and operation of the system; They do not meet European standards and do not provide the "Declaration of Conformity"; there is no post-sales service, as they sell out of reach and it would be impossible to meet such assistance and guarantees; and / or they are not tested products.
In view of the evidence obtained we do not find any legal justification to this practice done, because they are taking advantage of the efforts and reputation in the Spanish market C3 SYSTEMS, SL. A part of the imitation of our products themselves, are even making use of content corresponding to C3 SYSTEMS, SL they also used as a commercial argument that their products are the same as those of C3 SYSTEMS, SL and provide erroneous comparative information about prices that we offer our customers.
The actions previously mentioned constitute a clear infringement of such rights, which could lead to the prosecution exercised under Articles 138 et seq. the revised text of the Copyright Act.
Not only that, but they are leading to confusion and misleading our consumers and attributing benefits that are actually C3 SYSTEMS, SL. This promotion they are making of their products is an unfair action and infringement of Articles 5 ("acts of deception"), 6 ("acts of confusion"), 11 ("acts of imitation") and 20 ("deceptive practices by confusion for consumers ") of Law 3/1991, Unfair Competition, being entitled to the filing of the actions referred to in Article 32 of Law 3/1991 already mentioned.
We demand these companies the committment to respect the rights of C3 SYSTEMS, SL in future; if not proceed in the way we requested we will be free to exercise the legal actions we deem appropriate to defend our rights and interests.
